My approach to fees
Obtaining services from a lawyer can be
expensive and many clients have a legitimate concern about the fees they
will be charged.
I have felt that concern myself when I have sought assistance from other legal service providers.
I understand that as a client, you want to have a clear idea of the fees that you are likely to incur, but you also want to feel confident that you will get good service for the price you are paying. This is particularly so when your matter involves a significant amount of money, which is usually the case with property or commercial matters, and perhaps the largest financial commitment you will take on in your lifetime.
No doubt you will have noticed firms offering low cost “fixed fee” conveyancing services online. Whilst this may seem attractive at first, it’s important to know whether those firms will actually provide you with a qualified, experienced and caring property lawyer, and a single point of contact, to look after every aspect of your matter from start to finish?
If they don’t, then it’s worth considering whether the quality of advice and attention to detail will be where it should be for a ‘big ticket’ purchase or sale, like a residential or commercial property.
Typically, my fees are charged using a combination of:
- A fixed fee for a standard scope of work;
and,
- Time based billing if any additional work is required which is outside the standard scope of work.
At the start of your matter I will provide you with a fee estimate which will outline the fixed fee for the standard scope of work and some examples of additional fees that might be incurred if certain circumstances arise during your matter.
If
circumstances arise during your matter which require work outside the
standard scope of work, and additional fees are likely to be incurred, then I
will draw this to your attention, in an open and honest way, and as soon as practically possible, discuss your options with you.
Why don’t I work for fixed fee only?
A fixed fee works well when all elements of the work required can be identified at the outset and won’t be subject to any change.
Most legal services don’t fall into that category. In fact most legal services involve aspects that are uncertain. In this context, I believe the best approach is to seek to identify a standard scope of work covering all the minimum necessary tasks for a matter of a certain type and to set a fair fixed fee for that work.
Clients
are then charged additional fees only if their matter requires work
beyond the minimum necessary tasks.
About me
I started my legal career working as a lawyer with my father, Patrick Ebert, in his suburban law firm based in Strathpine on the north side of Brisbane. During that time I worked as part of a small but well-regarded team providing legal services to individuals, families, small business owners and property developers in the area.
Many of the firm's relationships with clients were built over a period of 30 years and multiple generations. I learnt the importance of genuine care and connection, integrity, hard work and humour.
I now operate my sole practice from my home office in Dutton Park on Brisbane's inner-southside. I try to run my office as sustainably as possible, so all electricity consumed comes from renewable sources, either from our rooftop solar, or 100% renewables from the grid. I also use technology wherever possible to minimise the unnecessary consumption of conventional office supplies and keep printing to a minimum when appropriate.
My Professional Values
I really value the relationships that I have with my clients. Connections between people create communities and being part of a community gives meaning to life. It really is that important!
Dealing with legal matters can be stressful and tedious for clients. I can’t guarantee that I can change that, but I aim to have my clients feel that, even though their matter may be difficult, at least they have a lawyer who is knowledgeable, caring and easy to communicate with.
When providing legal services to clients, I will act with honesty and integrity and seek to be caring, respectful and inclusive at all times.
